Nufern, OFS and FENA Settle Patent Litigation

EAST GRANBY, CT – February 7, 2007 - OFS Fitel LLC, Furukawa Electric Company of North America, Inc. (“FENA”) and Nufern have amicably settled patent litigation brought by OFS and FENA in the U.S. District Court for the District of Connecticut.

The parties are pleased to resolve this dispute, after over a year of litigation, on fair and reasonable terms.  Given the nature of the dispute and the risks of the litigation, the parties agreed that settlement was appropriate.

The terms of the settlement agreement are confidential but the parties are pleased to announce that the settlement does include a license to Nufern under U.S. Patent Nos. 4,909,816; 4,666,247; and 5,949,941.
